Ken is an accomplished trial lawyer, with extensive experience in complex commercial and class action litigation. Known nationally for his pharmaceutical and medical device litigation practice, Ken most recently served as national litigation counsel for Sulzer Orthopedics in more than 4000 civil actions following a product recall. Ken also played a significant role in the handling of several important cases at the appellate level, including the California Supreme Court and the Ninth Circuit. Ken also devotes considerable time to pro bono projects and was awarded the Lawyers' Committee for Civil Rights' Father Moriarty Award for his work on behalf of political asylum applicants.
Ken also has successfully represented such diverse clients as policyholders who have sued their insurance companies in coverage disputes, insurers sued in class actions for alleged unfair business practices and regulatory violations, cardiovascular medical device manufacturers sued for alleged product defects, a distributor of pool products which sued the manufacturer for breach of a distribution agreement, and an insurer sued for alleged antitrust violations.
Originally from New York, Ken moved to San Francisco in 1981 after living in Thailand and traveling through South and Southeast Asia for several years.
Ken is a member of the Association of Business Trial Lawyers, and the Lawyers' Committee for Civil Rights. Ken is also a frequent lecturer, and has presented for the National Business Institute on Litigating Class Actions, Lorman Education Services on Litigating Bad Faith Actions, the ABA's TIP Section on Voir Dire Techniques, the CEB on Discovery Procedures, as well as numerous other groups and topics.
Ken's clients include Guidant Corporation, LeapFrog Enterprises, Cendant Corporation, Zenith Insurance Company and a number of other commercial and financial services entities.
